Extended Warranty & Accidental Damage Protection

TERMS AND CONDITIONS

Section 1: EXTENDED WARRANTY

The Service Contract applies to parts and labor cost arising from a breakdown of the Product purchased with an EROS Service Contract Certificate (Eros Protect). Under this section, this Service Contract extends the warranty for the period stated on the Service Contract Certificate (the “Term”) commencing on the date of expiration of the original Product warranty period as stated on the Product’s initial guarantee.

If a covered Product suffers a breakdown caused by failure in materials, workmanship and/or performance during normal use, EROS (“we”,” us”, “our”) will repair it, up to a maximum of the original purchase price.

In the case of consumer products such as electronics and major appliances, the use is or has been limited to domestic and personal use. This coverage is extended to Office products such as facsimile machines and computers. These are covered for home and office use.

Limitation of Liability

EROS is entitled, at its sole discretion, to replace the Product with the same or similar Product rather than to repair the Product or in case the product is not repaired within 30 days. The retail value of the replacement will not exceed the purchase price that was actually paid by the customer (“you”, “your”). Once a warranted Product has been replaced, your cover under this Service Contract will end immediately with no refund. Any amount unpaid pursuant to the terms of this Service Contract at the time of replacement shall become due and payable to us.

This Service Contract also covers food damage loss that results from a mechanical, electronic or electrical component failure of a refrigerator or freezer. In the event that food is spoiled due to a covered breakdown of the Product, we will reimburse the Service Contract holder for such food spoilage up to a total of five hundred (500) UAE Dirhams per incidence provided the food spoilage has been verified and inspected within two (2) working days by the authorized repairer and properly documented.

 


Section 2: INSTANT REPLACEMENT

This section applies to carry-in Small Domestic Appliances up to a value of five hundred (500) UAE Dirhams only. Under this section, this Service Contract extends the warranty of the Product for the Term of this Service Contract Certificate commencing on the date of expiration of the original Product warranty period as stated on the Product’s initial guarantee.

If a covered Product suffers a breakdown caused by failure in materials, workmanship and/or performance during normal use, we will replace it with an equivalent model at our discretion, up to a maximum of the original purchase price. If an equivalent or alternative model is not available, then we may at our discretion, provide you with credit vouchers for the original purchase price. Once a warranted Product has been replaced, your cover under this Service Contract will end immediately with no refund.
Your product is covered for one (1) year from expiry of the original manufacturer’s warranty, providing that the original manufactures warranty is no longer than twenty four (24) months.

In the Event of Breakdown under Section 2

  • You must report the breakdown to us within five (5) days.
  • Check the manufacturer’s instructions and make sure the controls are properly set
  • Ensure it is not a breakdown that you can correct yourself, such as scaling, a blockage or blown fuse
  • Bring the faulty Product to your nearest store. The original receipt will be required for a replacement to be provided
  • A member of our staff will check the Product and if confirmed irreparable, may authorize an immediate replacement.

 

Section 3: EXTENDED WARRANTY PLUS (Accidental Damage)

Subject to the payment of the relevant premium and the applicable terms of this Service Contract, coverage under this Section will also apply in addition to Section 1 where the breakdown of the Product is caused by Accidental Damage and occurs within one (1) year from date of purchase of the Product.

The Product is protected against Accidental Damage from handling wherein coverage is limited only to operational and/or mechanical failure caused by an accident from handling during normal usage.

EROS is entitled to decide, at its sole discretion, to replace or to repair the Product or to provide a refurbished Product with the same or similar functionality. The applicability of this coverage is subject to the Terms and Conditions in this Service Contract and presentation of the damaged Product, satisfactory explanations of where and when the accident occurred as well as a detailed description of the actual event. Failure to provide this information will result in denial of coverage.

Once a warranted Product has been replaced, your cover under this Service Contract will end immediately with no refund.Once a warranted Product has been replaced, your cover under this Service Contract will end immediately with no refund.

Product Eligibility for Extended Warranty Plus Coverage
A EROS Service Contract with Accidental Damage may only be purchased at the time of Product purchase and only covers a Product that is over 501 AED when bought.

Exclusions Specific to Extended Warranty Plus Coverage

  • Normal wear and tear of items not integral to the functioning of the Product
  • Repairs necessitated by intentional physical damage, negligence, misplacement, burglary, theft, corrosion, animal and insect infestation, misuse, abuse and acts of nature including but not limited to earthquake, storm or typhoon, sand, water, flood, fire and lightning
  • Damage caused by repair of non-authorized personnel
  • Non-operating and cosmetic damage such as damage to paintwork, product finish, dents or scratches, to the equipment and broken glass items
  • Replacement of any consumable item or accessory due to Accidental Damage. These include, but are not limited to: plugs, fuses, batteries, light bulbs, light covers, cables, filters, attachments, belts, toner, ribbons, drums, tapes or software, add-on options incorporated in a product for which this contract was purchased
  • Damage to accessories used in or with the Product unless covered under a separate extended warranty service contract. (For example, modem, scanner, printer or charger)
  • Damage resulting from power outage, power surges or dips, fluctuating voltage, or improper voltage or current
  • Damage to Batteries internal or external to the Product
  • Failure to follow the manufacturer’s instructions
  • Damage arising from incorrect installation, modification or maintenance
  • Costs if no fault is found with the Product
  • Costs arising from being unable to use the Product or from damage which results from the Breakdown of the Product
  • Damage due to Commercial usage, as identified in the Service Contract Certificate.

 


Section 4: GENERAL TERMS & CONDITIONS

Eligibility for Coverage

  • The Product is purchased new from EROS and has an original Product warranty of at least one (1) year
  • A Service Contract covering Sections 1, 2 and 3 may only be purchased at the time of Product purchase
  • The Product is for personal and domestic use only

 


Limitation of Liability

This Service Contract is not an insurance policy or guarantee. This contract only covers a Product which failed due solely to material, workmanship, or performance of the Product.
Eros liability is limited to the purchase price of the Product to which this Service Contract applies. If the Product is replaced, the defective Product becomes EROS property.

EROS shall not be responsible for any loss or damage to a person or property, direct, consequential or incidental damages arising from the use of or inability to use the Product to the extent that law may disclaim such. This Service Contract does not cover any defects which are subject to a manufacturer’s recall or which are covered under a manufacturer’s program or reimbursement. EROS liability under this Service Contract shall in no event, exceed the purchase price of the Product.

This Service Contract is only valid in UAE.
In the event of theft, repossession or fraud, this Service Contract will be cancelled by EROS. If any installment payment is in default and unpaid for a period of three months, we may cancel the Service Contract at the bank’s discretion.
This Service Contract is offered by EROS. We reserve the right to vary, modify or otherwise amend the terms and conditions stated herein according to its sole discretion.

 


Cancellations
Service Contract once sold cannot be cancelled.



General Exclusions

  • Costs implicitly or explicitly covered by any manufacturer’s, supplier’s or repairer’s guarantee or warranty
  • Non-operating and cosmetic damage such as damage to paintwork, product finish, dents or scratches, to the equipment and broken glass items
  • Accessories used in or with the Product unless covered under a separate extended warranty service contract. (For example, computer software, modem, scanner, printer, and charger)
  • Replacement of any consumable item or accessory. These include, but are not limited to: plugs, fuses, batteries, light bulbs, light covers, cables, filters, attachments, belts, toner, ribbons, drums, tapes or software, add-on options incorporated in the Product for which this contract was purchased
  • Normal wear and tear of items not integral to the functioning of the Product
  • Routine maintenance, cleaning, lubrication, adjustments or alignments, overhaul, modification and de-scaling
  • Repairs necessitated by intentional physical damage, burglary, theft, corrosion, animal and insect infestation, misuse, abuse and acts of nature including but not limited to earthquake, storm or typhoon, sand, water, flood, fire and lightning
  • Damage caused by repair of non-authorized personnel
  • Damage resulting from power outage, power surges or dips, fluctuating voltage, or improper voltage or current
  • Reception or transmission problem resulting from external causes
  • Problems or defects not covered under the original product warranty
  • Batteries internal or external to the Product
  • Breakdowns caused by computer virus or realignments to Product
  • Recalls or modifications to the Product
  • Failure to follow the manufacturer’s instructions
  • Costs arising from incorrect installation, modification or maintenance
  • Costs if no fault is found with the Product
  • Costs arising from being unable to use the Product or from damage which results from the Breakdown of the Product
  • Commercial usage except Product used in rental property, as identified in the Service Contract Certificate.



In the Event of Breakdown

  • In order to be considered for coverage under this Service Contract you must report the breakdown or failure of the Product within five (5) days of occurrence
  • Product failure must not be due to any item listed under the General Exclusions section of this Service Contract
  • If the Product is within the Service Contract term, contact the Extended Warranty hotline number detailed on Service Contract certificate. You will be given instructions on how to proceed with the repair
  • Repairs must only be carried out by authorized service centers of relevant Products approved by EROS.
  • In-home service will be provided for all types of major appliances except for portable items (countertop microwave ovens, color televisions under 21”, portable Hi Fi systems, Home PCs, etc.) which should be brought into the authorized service centers of relevant products approved by EROS or brought into any EROS store
  • The EROS original store invoice must be presented for all repairs to the covered Product
  • If the breakdown is not covered by this Service Contract, you will be charged for the cost of the repair
  • You should first refer to the manufacturer’s instructions manual to determine if the failure to operate is due to circumstances that may be corrected


Fraud
All benefits of this Service Contract will be invalidated altogether if a fraudulent declaration or claim is made and /or a fraudulent activity is discovered.
